Tasks: Intellectual Property Rights (IP) Portfolio (Beverage & Snacks):
o Reviewing the IP portfolio of PepsiCo as a part of the global IP team of PepsiCo International.
 Managing the beverage and snack IP portfolio of PepsiCo which includes brands like, inter alia, Pepsi, Mirinda, 7Up, Slice, Tropicana, Gatorade, Lay’s, Stax, Kurkure, Cheetos, Lehar etc.
 Drafting and vetting pleadings for the purposes of instituting civil infringement and passing off actions against infringers of PepsiCo trademarks.
 Implementing protection measures required for existing trademarks of PepsiCo i.e. filing trademark registrations applications and opposing various trademark applications.
 Organizing enforcement actions against manufacturers of spurious beverages.
 Reviewing new proposed trademarks sought to be adopted by PepsiCo.
o Reviewing and assessing all advertisement scripts (television, radio and print) and labels.
o Assessing the IP (Designs, Patents and Copyrights) in various activities undertaken by PepsiCo to ensure adequate domestic and international protection.

Tasks: Contracts:
o Drafting and vetting of various agreements, which include:
 Celebrity Endorsement Agreements;
 Commercial Agreements (sponsorship, clearing & forwarding agent, advertising agency, media agency, sale, bailment, consultancy etc);
 Trademark and Copyright License Agreements.
o Implementing various contests and promotions of PepsiCo which included drafting and vetting of terms and conditions for such contests and promotions.

In relation to the above, I have been actively working with the Indirect Tax, Marketing, and Product Development teams of PepsiCo to provide legal solutions tailor made to fit the commercial requirements of PepsiCo.

June 2005 – October 2006: Anand And Anand, Litigation (Media & Entertainment Law and Trademark Group), New Delhi, India

Tasks: Significant Litigation Cases: Copyright & Trademarks Team:
o Advising and representing Mother Dairy / National Dairy Development Board on a suit claiming rights over their trademark, which entailed drafting and filing applications and affidavits; briefing Senior Counsels and appearing before Court. The main issues to be countered in this case were that of acquiescence and a well known mark.
o Advising and representing the Indian Performing Right Society in enforcing its ‘Public Performance Rights’ across the country through a litigation campaign. This involved investigating instances of violation, negotiating compliance, drafting and filing suits, briefing Senior Counsels and general maintenance of the portfolio consisting of over 60 cases;
o Advising and representing Emergent Genetics / Monsanto on a first of its kind cases involving a claim of copyright in a DNA Gene Sequence and breach of confidentiality i.e. Trade Secrets, which involved researching, briefing Senior Counsels and appearing before court
o Advising and representing the Lance Armstrong Foundation in instituting counterfeit actions for illegal use of their trademark, which involved investigations, drafting and filing the suit, appearing before the Court, organizing civil raids and negotiating settlements. The action was instituted by partnering with DLA Piper who engaged the services of Anand and Anand for the Lance Armstrong Foundation.
o Advising and representing General Electric Company in a counterfeit campaign protecting their trademark which included investigating instances of violations, drafting and filing suits, briefing Senior Counsels, appearing before Court, negotiating with infringers and organizing civil raids.
o Advising and representing Louis Vuitton in a pioneer case claiming rights over their ‘Texture Trademark’ which involved research on the law and appearing in court.
o Advising and representing Kensoft Infotec Ltd. in a non-literal software infringement and breach of confidentiality case which entailed understanding technicalities of software, researching and briefing senior counsels.
o Advising other clients such as Ardath Tobacco, Javed Akhtar, T-Series etc on various trademark and copyright issues.
o Assisted in handling and managing a portfolio of over 80 live litigation matters.

Tasks: Advisory & Corporate Drafting:
o Advised an Indian Market Research Company on issues of ‘Fair Dealing’ under the Copyright Act 1957.
o Advised an Indian Media Company on suitable brand names.
o Assisted in vetting agreements with emphasis on provisions relating to breach of confidentiality and trade secrets; non-disclosure and termination clauses.
